NRC supports states that have expressed interest in implementing NRC regulatory authority support programs in accordance with the Atomic Energy Act of 1954 as amended. Section 274 of the Act provides a legal basis on which NRC cedes part of its regulatory authority to states in order to license and regulate by-products (radioisotopes); raw materials (uranium and thorium); and certain quantities of special nuclear materials. The mechanism for transferring authority from NRC to a state is an agreement signed by the Governor of the State and the Chairman of the Commission in accordance with Section 274b of the Act. Some states, known as contracting states, have agreements with the NRC that give them the power to regulate radioactive material within their borders. In the particular situation of federally controlled sites in contracting states, nrc retains jurisdiction. (1) Must: at least 3 days prior to the first participation in each activity in a calendar year, a submission form containing an NRC 241 form, a “report on activities contemplated in non-party countries,” a copy of its contract-compliant licence and the corresponding fee under Section 170.31 of this chapter with the regional administrator of the regional office of the U.S. Nuclear Supervisory Authority , listed on form NRC 241 and in Appendix D of Part 20 of this chapter for the region in which the contracting state that issued the licence is located. If an emergency request or other reason cannot be submitted three days before participating in reciprocity activities, the Regional Administrator may, for an emergency or other reason, waive the 3-day period, provided that the taker meets the conditions of the treaty: nrc assistance to states that enter into agreements includes the review of requests for agreements 274b from states or amendments to existing agreements , meetings with states to discuss and settle comments on the review of NRRs and recommendations for the Commission`s approval of proposed 274b agreements. In addition, NRC organizes training and workshops; Assesses technical issues related to State Party licensing and inspections; assesses changes to the state rule Participates in the Activities of the Conference of Directors of the Radiation Control Program, Inc.; and provides rapid and substantial state participation in regulation and other regulatory efforts.

(iii) within three days of the application, an NRC 241 form, a copy of the contracting state licence and payment of the tax. Texas became an agreement in 1963 and has been regulating these radioactive substances ever since. Texas had previously regulated natural radioactive materials by which NRC did not have the authority to regulate. In addition, Texas regulates the radiation sources of lasers and X-ray machines, including mammography, over which NRC has no regulatory authority. 4. The general licence authorizes the possession or use of radioactive material for more than 180 days in a calendar year or activities authorized in paragraph (a) of this section, unless the general licence under paragraph (a) of this section relating to activities in offshore waters gives that person the right to hold or use radioactive materials. or to carry out the activities authorized for an unlimited period of time. (b) Notwithstanding a contrary provision of a given licence issued by a contracting state to a person operating in a non-contracting state, in an area of exclusive federal jurisdiction within a contracting state or in offshore waters under the general licences provided by this section, general licences are subject to all provisions of the Act.
